Terms of Service

These Terms of Service ("Terms") govern your use of WhichAudit ("the Service"), operated by WhichAudit ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

WhichAudit is intended for use by healthcare professionals, medical students, researchers, and individuals with a legitimate interest in NHS clinical audit and quality improvement. You must be at least 18 years of age to use the Service.

2. Content Submissions

By submitting content to WhichAudit, you confirm that:

• The submission contains no patient-identifiable data
• The content is your original work or you have permission to share it
• The submission complies with your employer's policies on publication and intellectual property
• You grant WhichAudit a non-exclusive, royalty-free licence to display, store, and distribute the submitted content
• The information provided is accurate to the best of your knowledge

WhichAudit reserves the right to review, reject, edit, or remove any submission at any time without notice.

3. No Patient Data

Submissions must not contain any patient-identifiable information as defined by the NHS Data Security and Protection Toolkit, including but not limited to names, NHS numbers, dates of birth, postcodes, or any combination of data that could identify an individual. Any submission found to contain patient-identifiable data will be immediately removed and may be reported to the relevant authority.

4. Intellectual Property

WhichAudit and its original content, features, and functionality are owned by WhichAudit and are protected by international copyright, trademark, and other intellectual property laws. User-submitted content remains the intellectual property of the submitter, subject to the licence granted in Section 2.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit false, misleading, or fabricated audit data
• Attempt to gain unauthorised access to any part of the Service
• Scrape or systematically extract data without written permission (API access is available — see API documentation)
• Use the Service to spam or harass other users

6. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. WhichAudit makes no representations or warranties of any kind, express or implied, including but not limited to the accuracy, completeness, or fitness for a particular purpose of any content on the Service. Content on WhichAudit is for educational and informational purposes only and does not constitute clinical advice. Always follow your local Trust policies and national guidelines.

7. Limitation of Liability

To the maximum extent permitted by law, WhichAudit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service or any content therein.

8. Account Termination

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms. You may delete your account at any time by contacting us at hello@whichaudit.com.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
